100 years in the past: Attorneys enchantment case for Ho Jim – Purple Bluff Every day Information


Attorneys W. A. Fish, N. A. Gernon and Timothy Healey have filed notice of appeal of the case of Ho Jim vs. George Martin, which was decided in the superior court in this county March 26th by the jury giving a verdict exonerating Martin of the blame and liability for damage in the death of Ho Fong, the thirteen-year-old Chinese lady who was killed by Martin’s automobile here last August 4.

The case attracted considerable attention during the trial in the court for three or four days. After the jury returned the verdict in favor of the defendant when the plaintiff was asking about $10,000 damages, the case was reopened in the superior court by attorneys for the plaintiff asking for a new trial on the ground that the court erred in instructing the jury.

The court denied the motion for a new trial in an opinion filed June 19, 1920 and now the case is being taken to the Third District court of appeals.
